1. These Directions are adopted to promote the skill training policy for inmates at correctional institutions under the Agency of Corrections, Ministry of Justice (referred to as the “Agency” hereunder) to increase training effectiveness and the skill levels of inmates.
2. A correctional institution may, in view of actual needs, conduct skill training for inmates at an appropriate place, and set up and operate a vocational training institution in accordance with the Measures for the Establishment and Administration of Vocational Training Institution. The training institution may start to offer relevant technician skill training and examination after its training places, facilities and equipment have passed the examination and issued a certificate.
3. Inmates selected by a correctional institution to participate in vocational skill training shall meet the following criteria, unless it is otherwise provided by law:
(1) Free of violation record within the past six months or having committed a minor violation for which no disciplinary action is imposed;
(2) Will be eligible for parole (exemption from training or termination of execution) or release from the correctional institution within five years after the completion of training, unless it is otherwise approved by the Agency due to some special circumstances; and
(3) Not held in isolation.
4. When selecting inmates for vocational training, priority should be given to those who are willing to receive skill training and employment counseling. If there is an insufficient number of inmates attending the training, a correctional institution may, in view of the actual situation, request approval of the Agency to select inmates at other correctional institutions that meet the criteria to attend the training, and submit a list of selected inmates to the Agency for review.
5. A correctional institution that plans to offer skill training shall submit a vocational training plan together with course schedule, course contents, funds needed, list of instructors and list of trainees to the Agency 15 days before the planned start day for approval.
6. Inmates who attend training program offered by the affiliated skill training center shall obtain labor insurance as required during the training period and bear their own deductible. A correctional institution shall inform inmates about insurance deductible beforehand;
7. A correctional institution should assign staff to manage training materials, machines and tools, produce a register book, and take count and put them away after use. The finished products and left-over or waste materials from the training program should be managed or disposed according to relevant rules to prevent unauthorized possession by inmates that may breed illegal activities.
8. A correctional institution should evaluate the performance of trainees during the training period, and dismiss trainees who violate rules or perform poorly in training. Dismissed trainees will not be allowed to participate in other vocational training programs.
9. A correctional institution shall conduct skill tests in accordance with the rules of the Ministry of Labor.
10. After conducting skill tests, a correctional institution shall submit a list of trainees who have passed the tests to the Agency for record.
11. When a trainee who has completed the training program is reassigned a job, a correctional institution may give the trainee the priority to be reassigned to a relevant workplace.
12. For an inmate who has completed a training program and is later on released, a correctional institution should forward his or her data to the local prosecutors office or a branch of Taiwan After-Care Association at where the inmate registers his or her domicile place to follow up on the employment status of the inmate.
