Legislative These Guidelines are established by the Taiwan Miaoli District Prosecutors Office to ensure the safety of personnel of the office, personnel of other agencies, and the public entering and exiting the office’s administrative building (hereinafter referred to as the “Building”), to regulate the methods and standards for conducting safety inspections, and to prevent unlawful violent acts, in accordance with the “Enhanced Safety Maintenance Measures for Prosecutorial Agencies under the Ministry of Justice.”
Content

1.          These Guidelines are established by the Taiwan Miaoli District Prosecutors Office to ensure the safety of personnel of the office, personnel of other agencies, and the public entering and exiting the office’s administrative building (hereinafter referred to as the “Building”), to regulate the methods and standards for conducting safety inspections, and to prevent unlawful violent acts, in accordance with the “Enhanced Safety Maintenance Measures for Prosecutorial Agencies under the Ministry of Justice.”

2.          Anyone entering the Building shall comply with these Guidelines and follow instructions given by the office personnel performing official duties concerning the maintenance of safety and order.

3.          Anyone entering the Building shall pass through metal detectors or X-ray machines and undergo security checks, except under the following circumstances:

(1)           Members of the public who have pacemakers, prosthetic devices, or other special conditions that make inspection by metal detectors inappropriate may, upon proactively informing safety inspection personnel, be exempted from inspection by metal detectors; however, their personal belongings shall still be screened using X-ray machines.

(2)           Personnel from other agencies visiting for official business may, with the approval of safety inspection personnel, be exempted from safety inspection after presenting an identification card or other identification document.

(3)           Employees of the Building (including employees of judicial agencies) may be exempted from safety inspection.

4.          Access security control for the Building and identification of persons entering and exiting may be conducted by means of access cards. The issuance, replacement, collection, and permission settings of the office’s access cards shall be controlled by the Civil Service Ethics Office to prevent security incidents in which a person enters the Building by using a forged or assumed identity.

5.          The methods for conducting safety inspections are as follows:

(1)           Persons subject to inspection shall remove all items from their pockets and place them on the platform at the entrance for inspection by safety inspection personnel.

(2)           Persons subject to inspection who carry handbags, backpacks, suitcases, or similar items shall open them and display the contents item by item for inspection by safety inspection personnel.

6.          Where any person carries firearms, ammunition, or knives suspected to fall under Article 4 of the Firearms, Ammunition, and Knives Control Act, narcotics as defined in Article 2 of the Narcotics Hazard Prevention Act, or other prohibited items, safety inspection personnel or other personnel shall notify the Court Police Office for handling, and such items shall be seized in accordance with the law.

Where any person carries any of the following items, such person may be prohibited from carrying the item, prohibited from entering the Building, or ordered to leave:

(1)           Items that are not firearms, ammunition, or knives as defined in Article 4 of the Firearms, Ammunition, and Knives Control Act but may pose a risk to the safety of the Building.

(2)           Items that undermine the dignity or order of the Building.

(3)           Animals other than guide dogs.

7.          Where any person falls under any of the following circumstances, office personnel performing official duties may prohibit the person from entering the Building or order the person to leave:

(1)           Refusal to undergo safety inspection.

(2)    Petitioning, protesting, or mobilizing support by means of slogans, posters, banners, leaflets, sit-ins, performances, or similar activities.

(3)  Taking photographs, recording video, or making audio recordings without permission.

(4)           Committing acts of violence, assault, or fighting.

(5)   Loud shouting, yelling, verbal disputes, or unauthorized broadcasting.

(6)    Apparent intoxication, use of hallucinogenic drugs, or abnormal mental state.

(7)  Engaging in commercial activities such as advertising, solicitation, or sales.

(8)           Loitering or wandering without legitimate reason.

(9)     Any other improper conduct that obstructs members of the public in conducting official business or affects the order of the Building.

8.          Where any person engages in any of the acts set out in Paragraph 7 and fails to make improvement after being advised, office personnel performing official duties in the Building may notify the police authorities for handling in accordance with the law, and prepare a handling summary for submission to the Chief Prosecutor and the Civil Service Ethics Office.

9.          Personnel entering the Building who carry items suspected of posing security risks or engage in irrational or other abnormal harmful conduct involving violations of the Social Order Maintenance Act or criminal offenses may be immediately stopped by duty personnel, who shall protect the safety of persons present. Where necessary, the police authority having jurisdiction may be notified to dispatch personnel to handle the matter.

10.      In response to irrational protests, disturbances under pretext, or other security situations, duty personnel may immediately disperse, handle, and stop such conduct, use protective equipment, and take necessary safety protection measures. They may also, where appropriate, coordinate with the police, fire, or other authorities to dispatch personnel for assistance, so as to maintain the safety of the agency and its personnel.

11.      Measures relating to the personal safety of office employees and the preservation of evidence are as follows:

(1)           Where an office employee—or the employee’s family members—suffers threats to life, person, or property as a result of the employee’s performance of duties, necessary preventive and protective measures may be taken, and, depending on the needs of the person concerned, the competent unit may be notified to activate an interagency protection network.

(2)           Within the premises of the office, in order to prevent the occurrence of crimes or hazards or to avoid imminent danger, personal safety protection shall be provided immediately to personnel who are being or have just been subject to unlawful infringement, and the matter shall be reported to the agency head in accordance with the procedures. Depending on the circumstances of the hazard or offense, the police authority may be notified, where necessary, to dispatch personnel to handle the matter. Where there is a need for immediate action by agency duty personnel, they may, with reference to the provisions on immediate coercion under Articles 36 and 37 of the Administrative Execution Act, take measures such as the restraint of persons, retention of objects, use or disposition of objects, or restriction of their use. Where the requirements for arresting a person in flagrante delicto are met, such a person may be arrested directly pursuant to Article 88 of the Code of Criminal Procedure, and the agency head shall be notified immediately for further handling.

12.    During regular work hours, safety inspections shall be conducted by security personnel on a rotating basis (including during the lunch break). Such personnel shall maintain a friendly attitude and observe proper courtesy. In the event of disputes or controversies arising in the execution of duties, the matter shall be immediately reported to the Chief Court Police and the Civil Service Ethics Office for handling. Where safety inspection equipment malfunctions, the matter shall be immediately reported to the General Affairs Section for handling. After work hours and on holidays, when the main entrance is closed, employees and members of the public shall enter and exit the Building through the Court Police Office; access points shall be controlled and safety inspections conducted by on-duty court police officers.

13.     On-duty court police officers or security personnel shall, during work hours, patrol the public areas on the first and second floors (including the restrooms) at least once every hour and shall continuously monitor safety conditions.

14.      These Guidelines shall take effect upon approval by the Chief Prosecutor. The same shall apply to any amendments.
